The jury in our med mal case returned a verdict of $6,171,118.60 for the wrongful death of a 3 yr old brain damaged child and separate medical injury to the mother. The case involved the late diagnosis of HELLP syndrome and lack of communication between the OB docs and the ER doctors. This was one of the first cases to go to trial, maybe the first, where the element of grief and sorrow was presented to the jury, and possibly the largest verdict for the death of a 3 yr old. While not specifically broken out, grief and sorrow was included in the wrongful death damages awarded to the parents.
